Mr. Burnham is in his 26th year of practice as a commercial litigator and appellate practitioner in business, construction, employment and real estate matters. Mr. Burnham has had significant litigation successes in legal disputes involving common interest communities and organizations such as homeowner associations, condominium associations, cooperatives, country clubs, dockominiums and senior developments. He has successfully represented both individuals and companies in complex cases, including those involving breach of contract, internet defamation, business torts, and fraud and deceptive trade practices. Some highlights include:

  • Obtaining appellate reversal of broker commission denial on multi-million-dollar sale
  • Representing country club members in successful actions to nullify country club’s “mandatory membership” requirement
  • Limiting $26 million claim to $5 million jury verdict in appearance for clients whose pleadings had previously been stricken in their entirety
  • Negotiating favorable multi-million-dollar settlement for telecommunications company against former president and founding shareholder in four-day mediation
  • Securing voluntary dismissal of Fair Housing Act action against real estate investor with single deposition and letter outlining basis for sanctions

Mr. Burnham prides himself in keeping his clients well-informed throughout all phases of litigation from initial consultation through settlement or trial, and appeal, if necessary. He is admitted to practice in all state courts in Florida and the United States District Court for the Southern District of Florida.
