In a recent case in the Fort Lauderdale federal court, Mr. Mavrick successfully defended a group of companies and the persons in charge of those companies in a wide-scale lawsuit brought by the United States Department of Labor. The Mavrick Law Firm was successful in obtaining discovery from the Department of Labor that it had resisted because it was trying to refrain from disclosing its factual sources for the case. The discovery information was crucial to the defense of Mr. Mavrick’s clients because the case was based on false statements that the business and its management were intentionally depriving numerous employees of their earned wages. After discovery motions and hearing before the Judge, Mr. Mavrick’s clients obtained needed information as to weaknesses in the Department of Labor’s case. Ultimately, Mr. Mavrick insisted that the Department of Labor be required to attend a Judicial Settlement Conference so that the case details and weaknesses could be vetted in settlement discussions that would be supervised by a Judge. The Judge then ordered the Judicial Settlement Conference, and this ultimately led to a settlement that was very favorable to Mr. Mavrick’s clients. The Department of Labor had originally sought highly punitive compensation from Mr. Mavrick’s clients and a wide-ranging injunction that would have caused irreparable damage to Mr. Mavrick’s clients. Due the vigorous defense of the businesses and their management, Mr. Mavrick was able to secure a favorable resolution of the case without the harmful terms originally demanded by the Department of Labor.

The Mavrick Law Firm also has had significant success in Broward Circuit Court. In one recent case, Mr. Mavrick successfully defended a Florida corporation and its owner in case involving a non-competition covenant and alleged breach of a joint venture agreement with a foreign corporation and its foreign owners. Mr. Mavrick insisted that the non-competition covenant was invalid and unenforceable. After highly contested briefing with the state court Judge, the parties and their counsel attended a scheduled evidentiary hearing in Broward Circuit Court. Following Mr. Mavrick’s argument, the Judge entered a court order that the non-competition covenant was invalid and unenforceable. Thereafter, the Mavrick Law Firm filed a counterclaim and cross claims against the foreign corporation and their owners. Because the owners of the foreign corporation resided in Europe, the Fort Lauderdale business litigation lawyers at the Mavrick Law Firm prepared the needed legal documents to effectuate service of process in Europe by means of the protocols of the Hague Convention. Thereafter, the foreign defendants failed to timely respond and tried to delay the court proceedings and escape liability on technical grounds. Mr. Mavrick then filed motions and court documents to have the Broward Circuit Judge enter judgment against the European business owners as soon as possible. Because of the quick handling of the case and fair decision making of the Broward Circuit Judge, the European owners decided on the eve of judgment being entered against them to agree to a global settlement of the case on terms that were very favorable to Mr. Mavrick’s clients.
